CyEx, a leading provider of cyber and data breach response solutions, today announced the release of its new white paper, The Future of Remediation for Privacy & Pixel Cases. Developed in partnership with The Harris Poll, the report highlights shifting consumer expectations around privacy class-action settlements and provides a roadmap for how companies can better address the consequences of data misuse.
Harvesting consumer data has become ubiquitous, with highly private information—such as search history, health conditions, and shopping behavior—collected, sold, and exploited. This widespread misuse has fueled lawsuits and settlements, often resolved through cash payouts that fail to address the underlying issue: consumers’ loss of digital privacy.
The survey of 1,523 consumers and 207 senior data professionals reveals a clear disconnect:
- 92% of consumers are concerned about data misuse, with nearly half reporting direct impacts – such as financial fraud to emotional stress.
- Only 15% of consumers feel very confident that companies are adequately protecting their information.
- 63% of consumers prefer proactive privacy tools—which can include services such as VPNs, Password Managers and Data Broker Opt Out – over nominal cash settlements
- 83% of consumers believe companies will continue to misuse data even after penalties, signaling deep distrust in current remedies.
“Cash payouts, while important in Privacy litigation, do not restore a person’s digital privacy. Consumers told us overwhelmingly that they want real, proactive tools that help them regain control of their data where possible,” said Jerry Thompson, President and Founder of CyEx. “We believe CyEx’s Privacy Shield represents a viable and strategic evolution in settlements in Privacy & Pixel class action litigation.”
The whitepaper argues that the remediation model for data misuse must evolve, just as it did for data breaches two decades ago. While breaches gave rise to credit monitoring and identity protection services, privacy misuse cases demand comprehensive privacy solutions to address risks at the source. The report also looks ahead to emerging challenges as enterprises integrate artificial intelligence, raising new concerns about how consumer data is collected, used and potentially weaponized.
CyEx, with over 20 years of expertise in breach remediation, is leading efforts to redefine how companies approach settlements by offering robust privacy tools that align with consumer demands and reduce systemic risk.
